Terms of Service

These Terms govern your use of the SpoonCheck iOS app and website. By using SpoonCheck you agree to these Terms. SpoonCheck helps you estimate food nutrition for general wellness tracking and is not a medical service.
1. Acceptance of these Terms
By downloading, accessing or using SpoonCheck, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, do not use SpoonCheck.
2. The service and eligibility
SpoonCheck estimates calories and macronutrients of meals from photos, offers an AI nutrition assistant, and lets you keep a food diary and track progress. You must be at least 13 years old, and old enough to form a binding agreement in your country, to use SpoonCheck. If you are under the age of majority, use it only with a parent or guardian.
3. Not medical advice
SpoonCheck is a wellness tool, not a medical device or healthcare service. It does not diagnose, treat, cure or prevent any condition, and it does not replace professional medical, nutritional or dietetic advice.
Always consult a qualified professional before making health decisions, and especially if you have diabetes, allergies, an eating disorder, are pregnant or breastfeeding, or have any other medical condition. Do not disregard professional advice because of something in SpoonCheck.
4. AI-generated estimates and content
Nutrition values, recognized dishes and assistant responses are produced with the help of AI and are approximate. They can be incomplete or wrong, especially when ingredients are hidden, portions are hard to see, or a meal is unusual. Use SpoonCheck’s output as guidance, not as exact measurement, and apply your own judgment.
5. Your content and license
You keep ownership of the content you provide (such as meal photos, diary entries and messages). You grant SpoonCheck a limited license to process that content solely to operate and provide the features you use — for example, sending a photo to our AI provider to estimate nutrition. You are responsible for the content you submit and confirm you have the right to submit it.
6. Acceptable use
You agree not to misuse SpoonCheck, including: attempting to break, overload, reverse engineer or gain unauthorized access to the service; using it unlawfully; or interfering with other users. We may suspend or terminate access that violates these Terms.
7. Subscriptions, billing and free trial
SpoonCheck offers an optional auto-renewing premium subscription, sold through Apple’s in-app purchase system. Current plans are a monthly plan (US$4.99/month) and an annual plan (US$29.99/year); both may include a free trial (currently 3 days). Prices may vary by region and are always shown in the App Store before you confirm a purchase.
- Payment is charged to your Apple Account at confirmation of purchase.
- The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period.
- If a free trial is offered, any unused portion is forfeited when you purchase a subscription, where applicable.
- You can manage or cancel your subscription in your Apple Account settings (Settings → your name → Subscriptions) after purchase.
- Refunds are handled by Apple under the App Store terms; we generally cannot issue refunds directly.
Your use of the app is also subject to Apple’s Licensed Application End User License Agreement (the Apple standard EULA): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ .
8. Third-party services
SpoonCheck relies on third parties, including Apple (Sign in with Apple, HealthKit, StoreKit, speech recognition), Google (Gemini) and DeepSeek for AI, and RevenueCat for subscription management. Their handling of data is described in our Privacy Policy. Your use of platform features is also subject to the applicable provider’s terms.
9. Disclaimers
SpoonCheck is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that estimates will be accurate, or that the service will be uninterrupted or error-free.
10. Limitation of liability
To the maximum extent permitted by law, SpoonCheck will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your reliance on nutrition estimates or assistant guidance. Nothing in these Terms limits liability that cannot be limited under applicable law.
11. Termination
You may stop using SpoonCheck at any time and delete your account from within the app. We may suspend or end access if you violate these Terms or if needed to protect the service or its users.
12. Changes to these Terms
We may update these Terms as the product changes. We will update the “last updated” date and, for material changes, provide notice. Continued use after an update means you accept the revised Terms.
13. Governing law
These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your country of residence apply. This does not affect your statutory rights as a consumer.
